Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?

I got laid off from Company A in Jan.2009 but I filed transfer for my H1-B to Company B based on receipt notice which I have for Company A. but Just now I came to know from USCIS that Transfer which I filed for Company A in Oct.2008 has RFE and Company A denied to answer RFE cos I am no longer their employee.
Question:
1. Can I get a receipt notice for Company B ?
2. Is there really an Issue for my Transfer to company B due to RFE in previous filing?

Hi everybody,
I am in pretty awkward situation. i have got my H1b Stamped in august 2008. Did not go to US because of the bad market situation and opted for woking in India. Now my current indian comapny wants me to travel to US on business visa( i have got B1 stamped in 2004 for 10 years) for 1-2 weeks.
Now i want to know , if i have both the visa stamped( H1b & B1), can i travel to US on business visa without affetcing my H1B visa because i am planning to go US whenever i hear that market is improving.

This Skil bill in HR development looks very exciting....may be this will be the our savior bill. Now senate and house both has similar bills and based upon the trend, it looks there is not much resistance to this new bill.
I hope with in few weeks we, the retrogression sufferers will be out of the dodge.

I applied for EAD renewal at NSC on 07/03/08 and today 08/06/2008, the status shows card production ordered. I applied for my wife along with me and her status shows still received.
Does the dependent (spouse) EAD in general get approved a few days after the primary applicants EAD is approved? I am not really using the EAD, its my wife who is using it, and thats the concern.

Hi All,
My wife is joining me on a H4. I plan to get her visa converted to H1 and my company is ready to sponsor her visa for conversion. Pls let me know if H4 to H1 visa is a tough thing. And also is there is last date we have to file the papers for this?? is it treated as a regular h1 quota or it lies outside of the quota and can it abe applied anytime??
She has a 16 yrs degree and has work exp which qualifies her for visa.

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.
