Hi,
I have my EAD/AP. I'm EB3-I.
I paid my attorney for the 485 processing. But the law firm works for my company.
They have been good so far (law firm) but I guess it would be better for me to first change the attorney If I plan to file AC21.
I would appreciate it if someone can suggest me good attorney . What would be the fee I can be looking at to pay the new attorney at this point of my GC. processing( With EAD/AP ..renewal also taken care.)
(If it is not appropriate to mention the figure I would appreciate it if someone can just give me a range/ballpark figure)

While President Bush threatens to use his veto pen to stop some bills and Senate Republicans block other measures from even reaching his desk, no force in Washington can halt the Democrats' investigative juggernaut from uncovering the secrets inside this administration.
For the first six years of the Bush administration, these aides were allowed free rein to carry out whatever policy or political assignments they wished -- or supposed that the president wanted done. A Congress under firm Republican control was somnolent when it came to oversight of the executive branch. No Republican committee chairman wanted to turn over rocks in a Republican administration.
You have to feel a twinge of sympathy now for the Bush appointees who suddenly find unsympathetic Democratic chairmen such as Henry Waxman, John Conyers, Patrick Leahy and Carl Levin investigating their cases. Even if those appointees are scrupulously careful about their actions now, who knows what subpoenaed memos and e-mails in their files will reveal about the past?
They will pay the price for the temporary breakdown in the system of checks and balances that occurred between 2001 and this year -- when the Republican Congress forgot its responsibility to hold the executive branch accountable.
It was a fundamental dereliction of duty by Congress, and it probably did more to encourage bad decisions and harmful actions by executive-branch political appointees than the much-touted lobbying influence. In reality, many Republican members of Congress did not mind what was happening because they were able to get favors done in that permissive climate. Now, the Democratic investigators will publicize instances of influence by members of Congress, and the political fallout will not stop with New Mexico's Pete Domenici and Heather Wilson.
Democrats find it easier to investigate than to legislate. With their major initiatives, from a minimum-wage boost to a shutdown of the Iraq war, stymied by Republican opposition, the Democrats are understandably making "accountability" their new goal -- meaning more and more investigations.
Fulfilling that promise, later in the week the House passed a series of bills that stripped some of the secrecy from executive branch documents and decisions.
Accountability is certainly important, but Democrats must know that people were really voting for action on Iraq, health care, immigration, energy and a few other problems. Investigations are useful, but only legislation on big issues changes lives.

Hi,
I heard that if the filing of the 140 /labor /485 (any of them) have the filing date < 1 year at the end of the 6 year of h1b then I can not extend my H1B for the 7th year.
Questin: Is this correct?
Details:
Filled labor in june 2007.
Filled 140 /485 in aug 2007
6th year H1B completed in feb 2008.
Question: Am I eligible for the 7th year h1b extension?
If yes then for how many years of extenstion I get?
If not then please suggest what to do.
Note : I have not changed my employer since last 3 years.

Hi,
My sister is a citizen and she applied GC for my parents who are in India.She applied for I-130 in April and it was approved in 2 months.She now has to fill the form I-864 and is in the process of doing so.Meanwhile my parents would like to visit USA.They'll be coming in December and be staying for 6 mos.They have a 10 yr visa and visited us back in 2004.
My question is it ok for them to visit USA?I read that they might be denied entry becasue of their approved I-130.We do not want to apply AOS here and they will return in June 09.
Thanks for any advice.

For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card

You can transfer your H1 to another company and you will get extension of same validity period (check your I94 Expriry period).
You can retain the priority date of your labour when you file I-140 in the new company.
By the way, why dont you start your I485 process now in the current company? You have lived with them for so long, 6 more months after applying I485, may not be a matter I think.....

Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT
